Fergs Kayaks Gift Card Terms & Conditions

1. General

1.1 These Terms & Conditions (“Terms”) apply to all gift cards issued by Fergs Kayaks Auckland (“Gift Card(s)”).
1.2 Gift Cards are redeemable for tours, lessons, and retail goods offered by Fergs Kayaks or Iti Adventures, as specified at the time of redemption.

2. Validity & Expiry

2.1 Gift Cards have an expiry date printed on the card or, for digital Gift Cards, communicated at the time of purchase or issuance.
2.2 From 16 March 2026, Gift Cards sold must have a minimum expiry period of three (3) years from the date of sale or issuance, in accordance with the Fair Trading (Gift Card Expiry) Amendment Act 2024 and related consumer protection requirements.
2.3 The expiry date (or period of validity) will be displayed prominently on or with the Gift Card in compliance with New Zealand law.
2.4 Gift Cards not redeemed by the expiry date will no longer be accepted for redemption after expiry, except where otherwise required by applicable law.

3. Legacy Gift Cards & Vouchers

3.1 Prior to Fergs Kayaks’ acquisition in October 2024, certain gift cards or vouchers were issued under previous ownership and terms.
3.2 It was agreed at acquisition that these legacy Gift Cards would be honoured through 31 December 2025 and this was communicated via the company website.
3.3 After 01 January 2026, legacy Gift Cards and vouchers will no longer be accepted for redemption unless the expiry date printed on the card extends beyond this date in accordance with applicable law.

4. Outstanding Liabilities

4.1 Any unredeemed Gift Cards and vouchers issued by the previous owners remain obligations of the previous owner’s legal entity and not of Fergs Kayaks after the honouring period stated above.
4.2 Fergs Kayaks does not assume liability for any outstanding debts or unfulfilled claims relating to legacy gift cards beyond 31 December 2025.

5. Redemption Rules

5.1 Gift Cards may be redeemed in person at participating locations (Fergs Kayaks Auckland) or online where applicable, subject to availability and booking requirements.
5.2 Gift Cards are not redeemable for cash unless required by law.
5.3 Lost, stolen, or damaged Gift Cards will not be replaced or refunded except where required by law.

6. Change in Value or Pricing

6.1 If the price of goods, tours, lessons, or services changes after a Gift Card is issued, the holder must pay any difference in price at the time of redemption.

7. Compliance with Law

7.1 These Terms will be interpreted and enforced in accordance with applicable New Zealand law, including, but not limited to, the Fair Trading Act 1986 and the Fair Trading (Gift Card Expiry) Amendment Act 2024 (effective 16 March 2026).
7.2 Should any part of these Terms conflict with applicable legal requirements, the legally required terms will take precedence.

8. Amendments

8.1 Fergs Kayaks reserves the right to amend these Terms from time to time.
8.2 Updated Terms will be published at https://fergskayaks.co.nz
