Tours Terms and Conditions – Fergs Kayaks

1. General Conditions

  • All participants must complete a disclosure of risk form before the tour.

  • Minimum age for participation is depends on the tour:

    • Rangitoto Volcanic Tour - 14 years

    • Rangitoto Night Tour - 16 years

    • Motukorea / Browns - 10 years

    • North Head Adventure - No age limit

    • Harbour Lights by Night - 14 years

  • Custom tours can be arranged for groups of 6 or more; please contact us directly for details.

  • Tours may be amended or cancelled due to weather, safety concerns, or other circumstances beyond our control.

2. Cancellation by Fergs

  • We reserve the right to cancel or amend any tour due to inclement weather, road closures, water conditions, or other safety requirements at the guide’s discretion.

  • We will make every reasonable effort to notify participants as soon as possible if a cancellation is necessary.

  • If we cancel a tour before departure, you will be offered either a full refund or the option to transfer your booking to an alternative date.

  • If a tour has already commenced, the itinerary may be altered for safety reasons.

  • Fergs is not liable for any additional costs incurred by participants due to cancellations.

  • No refunds are available on Gift Cards under any circumstances.

  • These terms are subject to your rights under the Consumer Guarantees Act 2003.

3. Cancellation by the Participant

  • 75% refund if cancelled at least 48 hours prior to departure.

  • 50% refund if cancelled at least 24 hours prior to departure.

  • 0% refund if cancelled with fewer than 24 hours’ notice, including:

    • Missing the tour departure time.

    • Failing to arrive.

    • Participant unsuitability due to age, ill health, poor fitness, inappropriate physical size, intoxication, or other factors.

4. Risk Disclosure

  • Outdoor activities carry inherent risks, including but not limited to drowning, falling, or environmental hazards.

  • Fergs Kayaks has a robust health and safety management system in place, audited annually by an external provider and compliant with Adventure Activities Regulations.

  • While risks are managed carefully, it is not possible to eliminate them entirely. Serious injury or death may result from participation.

  • Participants must listen to and follow all safety briefings and guide instructions at all times.

5. Restrictions

  • Participants must be fit and healthy enough to complete the trip.

  • Maximum weight limit: 120 kg to fit safely into kayaks (seat width: 65 cm).

  • Participants must be able to paddle continuously for up to 45 minutes.

  • All tours are conducted in English; participants must understand and follow safety instructions in English.

6. Environmental Responsibilities

  • Fergs is proud to hold a Pest Free Warrant.

  • To help protect its wildlife and landscapes, please ensure all clothing, footwear, and gear are clean and free from soil, seeds, or stowaway pests before your trip.

  • Fergs Kayaks is a Pest Free Approved Operator. We are very proud of our commitment to ensuring the Hauriki Gulf remains Pest Free. With this in mind we ensure that all participants are informed prior to their experience about their responsibilities when taking part in any experience that is undertaken in pest free areas.

  • Checking Gear
    Inspect bags, tents, backpacks, and especially stored items for hidden pests like rats, mice, ants, and skinks.

  • Cleaning Footwear & Gear
    Brush off all soil, seeds, and organic debris from shoes and equipment.

  • Seal Everything
    Pack all food in hard, sealed containers, keep bags zipped, and boxes taped shut.

  • No Food Left Behind
    Take all your rubbish with you; there are no bins on some protected islands.

7. Personal Privacy

  • Any personal information provided will only be used for the purpose of delivering our services.

  • Information will not be shared with third parties except where required by New Zealand law or regulatory authorities.

8. Photography and Video

  • Photos and/or video may be taken during tours.

  • By participating, you agree that such media may be used by Fergs Kayaks for promotional purposes without further consent or compensation.
